Drafted by Senators Mitch McConnell, Republican of Kentucky, and Jeff Merkley, Democrat of Oregon, the bill provision [17] aims to amend the hemp law established in the 2018 farm bill to prevent the sale of hemp-based intoxicating products. However, the changes would be implemented over the course of one year.
The one-year delay would allow current hemp farmers to finish this year’s crop under existing rules while giving lawmakers time to discuss and finalize new regulations to ensure a smoother transition without disrupting ongoing farming, according to Senator Merkley’s Thursday hearing.

The House and Senate Committees on Appropriations have approved FY2026 Agriculture appropriations bills [22] (H.R. 4121 [23] and S. 2256 [24]) that would similarly redefine the statutory definition of hemp to restrict the commercial production, sale, and distribution of certain hemp-derived cannabinoid products. House appropriators have expressed that the provision would close "the hemp loophole that has resulted in the proliferation of unregulated intoxicating hemp products [25]." During Senate committee markup [26], Senator Mitch McConnell expressed that the existing hemp definition has resulted in "an unintended consequence that has allowed for intoxicating hemp-derived synthetic products to be made and sold," calling for changes to reflect "the original intent of the 2018 farm bill [26]" by closing the loophole. The Senate provision would delay implementation for one year; the House provision does not include this delay. Similar action was debated [27] but not enacted in the 118th Congress.

Of 18 total studies, 10 met all of the criteria. All studies reported an increased risk for psychosis-like events or schizophrenia, and in nine of the ten studies there was a significant increase. Overall, the odds ratio of developing psychosis like events or schizophrenia was 2.88. If the cannabis use occurred during adolescence, the risk was two times higher. The Hill criteria indicated a high likelihood for the contribution of cannabis to schizophrenia development. (The Bradford Hill criteria are used in epidemiology to evaluate the strength of evidence for a causal relationship between an exposure and an outcome.)

The policy implications of semi-synthetic 7-hydroxymitraynine products are unknown, but adverse events or fatalities resulting from 7-hydroxymitragynine products could pose complications to the regulation of a growing kratom industry. Kratom is now used by 10–15 million US adults. Decisions regarding kratom scheduling and regulation are liable to become confused if policymakers can or will not differentiate between kratom and high-potency 7-hydroxymitragynine products synthesized in unregulated or makeshift laboratories. To be clear: equating 7-hdyroxymitragynine products to kratom is analogous to equating synthetic cannabinoids to unaltered cannabis or hemp. Although not all organic kratom products are equal, they have not emerged as a net detriment to public health, and they remain unscheduled at the federal level. Kratom has addictive properties and can be dangerous to use. The Poison Information Centre reports that several people in Sweden have sought medical attention after ingesting kratom. There are also several cases, according to the National Board of Forensic Medicine, where mitragynin has contributed to death or been the cause of death, writes FHM in a press release. [89]

This Sweden Herald article strengthens the case for banning kratom by documenting its lethal risks (deaths, addiction), surging use (40 tons imported), and narcotic classification, mirroring your concerns about its untested dangers and the 5,800 U.S. deaths. It undermines regulation—such as the FKCPA or KCPA—by suggesting these measures can’t address kratom’s intrinsic hazards, enforcement challenges, or deceptive health claims, especially for self-medicating users (Scientific American, 2021). After questioning her son, he told her that after he ate the piece of candy, and said the other student revealed it was an edible.

Kratom is not regulated as a controlled substance, though the Drug Enforcement Administration lists it [164] as a “drug of concern.” The FDA has not approved kratom for any purpose, but supplements do not require the agency’s sign-off to be sold.

Kratom was the cause of 91 overdose deaths from July 2016 to December 2017, according to a report [165] from the Centers for Disease Control and Prevention. We were told those seven students had to be rushed to the hospital after ingesting the gummies that officials said were brought to school by a student.
The sirens of first responders were heard loud and clear outside of the school Tuesday afternoon.
The seven students were taken to Texas Children’s and Kingwood hospitals after ingesting the gummies.
It’s unclear who originally gave one of the students those gummies, but if you’re 21 and up and live in Texas you can buy multiple forms of THC in most gas stations.
